Lawyers for Cosby filed a motion earlier this month requesting that the Supreme Court reconsider trial judge Steven O’Neill’s decision to imprison the 81-year-old immediately after handing down his September sentence for sex assault.
Cosby’s lawyers requested the higher court permit an ethics expert to weigh in on their new application, which suggested O’Neill had exhibited bias in his decision to revoke Cosby’s $1 million bail at sentencing.
The embattled entertainer’s attorneys kicked off their secondary appeals filings Thursday — which also allege misconduct by O’Neill. O’Neill denied Cosby’s initial challenge to his conviction in October.
Cosby was sentenced to three to ten years behind bars for the 2004 drugging and sexual assault of friend Andrea Constand.
He’s currently housed in a single cell in Pennsylvania’s SCI Phoenix prison.
